Welcome to Pet Trial Finder. These Terms of Service ("Terms") govern your access to and use of our website, services, and applications (collectively, the "Service").

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

PLEASE READ THESE TERMS CAREFULLY BEFORE USING OUR SERVICE.

1. Acceptance of Terms

By accessing our website or using our Service, you:

• Acknowledge that you have read and understood these Terms
• Agree to be bound by these Terms and our Privacy Policy
• Represent that you are at least 18 years old and have the legal capacity to enter into this agreement
• Represent that you are the legal owner or authorized caretaker of the pet(s) you are registering
• Agree to comply with all applicable local, state, national, and international laws and regulations

If you are using the Service on behalf of an organization (such as a veterinary clinic), you represent and warrant that you have the authority to bind that organization to these Terms.

2. Description of Service

Pet Trial Finder is a clinical trial matching and application submission service for pet owners. We search active trials against your pet's profile, identify matches, and — upon your instruction — aggregate your pet's information into a complete application package and submit it directly to matched research teams on your behalf. Our Service includes:

• Trial Matching: Matching pets with appropriate clinical trials based on species, breed, medical conditions, location, and other criteria
• Application Submission: Upon your instruction, aggregating your pet's complete profile, formatting it into a professional application package, and submitting it directly to matched research teams on your behalf
• Application Management: Managing trial application submission on the owner's behalf. Pet Trial Finder does not assess or determine eligibility — that determination is made solely by the research team
• Educational Resources: Providing information about veterinary clinical trials and research
• Database Services: Maintaining a database of active clinical trials and participant information

Important: Pet Trial Finder is a clinical trial matching and application submission service. We do not conduct clinical trials, provide veterinary care, diagnose conditions, determine clinical trial eligibility, or make medical recommendations. Eligibility determinations are made solely by the research teams at the participating institutions. All clinical trial participation is subject to the trial's own eligibility requirements and approval by the trial's researchers and veterinarians.

3. User Responsibilities

3.1 Service Access

Pet Trial Finder does not require account registration, login credentials, or membership to use the Service. Users access the Service by completing the intake form and payment flow. You are responsible for:

• All activities associated with your use of the Service
• Ensuring that any payment method you provide is valid and authorized for use
• Ensuring that your submitted information remains accurate and complete

3.2 Accurate Information

You agree to provide truthful, accurate, and complete information about yourself and your pet(s), including:

• Contact information
• Pet medical history and current health conditions
• Current medications and treatments
• Vaccination records
• Veterinary information

False or misleading information may result in:

• Disqualification from clinical trials
• Potential harm to your pet
• Legal liability

3.3 Veterinary Consultation

Before enrolling your pet in any clinical trial, you agree to:

• Consult with your current veterinarian about the trial
• Understand the potential risks and benefits of trial participation
• Review and sign any required consent forms directly with the trial researchers
• Follow all instructions and protocols provided by the trial veterinarians
• Report any adverse events or concerns immediately

3.4 Compliance with Trial Requirements

If your pet is accepted into a clinical trial, you agree to:

• Attend all scheduled appointments and follow-up visits
• Administer medications or treatments as directed
• Report any changes in your pet's condition
• Complete all required documentation and surveys
• Notify the trial team if you wish to withdraw from the trial

4. Fees and Payment

4.1 Service Fees

Pet Trial Finder charges the following fees:

• $7 Matching Fee: A one-time fee to search 147 active clinical trials across 25 accredited veterinary universities against your pet's profile. Returns all matched trials with full descriptions, eligibility criteria, and funding details. This fee is charged at the start of the process and is non-refundable regardless of match outcome.
• $23 Application Fee: A one-time fee charged only when you actively choose to proceed after reviewing your matches. This fee is never charged automatically. It covers aggregating your pet's complete profile, formatting it into a professional application package, submitting it directly to every matched research team, and handling initial correspondence. One fee covers all matched trials.

All fees will be clearly disclosed before you are charged. Current fees are listed on our website at https://www.pettrialfinder.com/pricing.

4.2 Fee Trigger and Authorization

The $7 Matching Fee is charged when you initiate a search. The $23 Application Fee is charged only upon your explicit selection after reviewing your match results. You will be presented with your matches before any decision to proceed. You are never automatically charged the $23 Application Fee. If no trials match your pet's profile, the $23 Application Fee is not charged.

4.3 Payment Processing

Payments are processed securely through Stripe, our third-party payment processor. By providing payment information, you:

• Authorize us to charge your payment method for applicable fees
• Represent that you are authorized to use the payment method
• Agree to Stripe's terms of service and privacy policy
• Agree to pay all applicable taxes

4.4 Refund Policy

No Refunds. All fees paid to Pet Trial Finder LLC are non-refundable. The $7 Matching Fee is retained regardless of whether matching trials are found. The $23 Application Fee is non-refundable once application submission has been initiated. Because the $23 Application Fee is only charged upon your explicit instruction after reviewing your matches, no discretionary refund process exists. Do not submit a payment expecting a refund — none will be issued.

4.5 Clinical Trial Costs

Important: The $7 Matching Fee and $23 Application Fee are separate from any costs associated with clinical trial participation. Clinical trials may provide free treatment and monitoring, or may require participant contributions. All costs related to trial participation are determined by the trial sponsors and researchers, not by Pet Trial Finder.

5. Clinical Trial Participation

5.1 No Guarantee of Acceptance

Pet Trial Finder does not guarantee that:

• Your pet will be matched with any clinical trials
• Your pet will be accepted into a matched trial
• A matched trial will be available in your geographic area
• Trial participation will benefit your pet's health

5.2 Trial Selection Authority

Clinical trial researchers have sole authority to:

• Determine eligibility requirements
• Accept or reject participants
• Remove participants from trials
• Modify trial protocols
• Terminate trials early

5.3 Informed Consent

Before participating in any clinical trial, you will be required to:

• Review the trial's informed consent documents
• Understand the trial's purpose, procedures, risks, and benefits
• Sign consent forms directly with the trial researchers
• Receive approval from your current veterinarian (when applicable)

Pet Trial Finder's role is to match your pet's profile against active trials and, upon your instruction, submit a complete application package to matched research teams on your behalf. Pet Trial Finder does not determine eligibility, does not provide veterinary advice, and does not advocate for your pet's acceptance. Eligibility determinations are made solely by the research team. We are not party to the consent agreements between you and trial researchers.

6. Intellectual Property Rights

6.1 Our Content

All content on the Service, including text, graphics, logos, images, software, and design, is the property of Pet Trial Finder or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not:

• Copy, reproduce, modify, or distribute our content without permission
• Use our trademarks, logos, or branding without written authorization
• Create derivative works based on our Service
• Reverse engineer or decompile any software

6.2 Your Content

By submitting information, photos, or other content to our Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display that content for the purposes of:

• Providing our Service
• Matching you with clinical trials
• Preparing and submitting application packages to research teams
• Improving our Service
• Marketing and promotional purposes (with your consent)

You represent that you own or have the necessary rights to the content you submit and that it does not violate any third-party rights.

7. Prohibited Uses

You agree NOT to use the Service for any of the following purposes:

• Providing false, misleading, or fraudulent information
• Impersonating another person or entity
• Violating any laws or regulations
• Infringing on intellectual property rights
• Transmitting viruses, malware, or harmful code
• Attempting to gain unauthorized access to our systems
• Scraping, crawling, or harvesting data from our Service
• Interfering with the Service's operation or other users' access
• Using the Service for commercial purposes without authorization
• Harassing, threatening, or abusing other users or staff
• Spamming or sending unsolicited communications
• Circumventing security measures or access controls

Violation of these prohibitions may result in immediate suspension of your access to the Service and legal action.

8. Disclaimers and Limitations of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties of accuracy, reliability, or completeness of information
• Warranties of uninterrupted or error-free service
• Warranties that defects will be corrected

8.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PET TRIAL FINDER LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Harm to your pet resulting from clinical trial participation
• Actions or omissions of clinical trial researchers or veterinarians
• Service interruptions, technical failures, or data loss
• Unauthorized access to your submitted information
• Errors, omissions, or inaccuracies in application packages that result from incomplete or incorrect information provided by the user
• Research team decisions made on the basis of submitted application packages, including eligibility rejections, scheduling delays, or enrollment outcomes

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR $100, WHICHEVER IS GREATER.

8.4 Third-Party Services

Pet Trial Finder LLC transmits application packages to research institutions on your behalf as instructed. We are not responsible for eligibility determinations, scheduling decisions, or outcomes made by research teams after receiving your application. We are not responsible for the actions or content of clinical trial researchers, veterinarians, payment processors, or linked websites beyond our own submission and correspondence actions.

9. Indemnification

You agree to indemnify, defend, and hold harmless Pet Trial Finder LLC, its officers, directors, employees, agents, affiliates, and partners from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any laws or third-party rights
• Content you submit to the Service
• Your pet's participation in clinical trials
• Disputes with other users or third parties

10. Privacy

Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy at pettrialfinder.com/privacy-policy to understand how we collect, use, and protect your information.

By using the Service, you consent to our collection, use, and sharing of your information as described in the Privacy Policy.

10.1 Health Data and Application Submission

When you purchase the $23 Application Fee service, Pet Trial Finder LLC compiles your pet's health information — including diagnosis, treatment history, age, weight, breed, and veterinary details — into an application package and transmits it directly to matched university research teams. By authorizing the $23 Application Fee, you consent to this transmission. Your data is stored using Airtable, a third-party database service. Payment processing is handled by Stripe. Neither Airtable nor Stripe receive your pet's health information beyond what is required to operate the service.

11. Modifications to Service and Terms

11.1 Service Changes

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation of the Service.

11.2 Terms Changes

We may update these Terms from time to time. When we make material changes, we will:

• Update the "Last Updated" date
• Post the revised Terms on our website
• Notify you via email or prominent website notice

Your continued use of the Service after the effective date constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Service.

12. Termination

12.1 Termination by You

You may stop using the Service at any time. For questions or to request deletion of your submitted data, contact us at support@pettrialfinder.com.

12.2 Termination by Us

We may suspend or terminate your access to the Service immediately, without notice, if:

• You violate these Terms
• You provide false or misleading information
• You engage in fraudulent or illegal activity
• You abuse or harass other users or staff
• We are required to do so by law

12.3 Effect of Termination

Upon termination:

• Your right to use the Service immediately ceases
• You remain liable for any fees incurred before termination
• Sections of these Terms that by their nature should survive (e.g., disclaimers, limitations of liability, indemnification) will continue to apply

Pet Trial Finder LLC retains submitted application data for operational and legal compliance purposes. To request deletion of your personal data, contact support@pettrialfinder.com.

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, United States, without regard to its conflict of law provisions.

13.2 Dispute Resolution

Informal Resolution: Before filing a claim, you agree to contact us at legal@pettrialfinder.com to attempt to resolve the dispute informally.

Arbitration: If informal resolution fails, any dispute arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, rather than in court.

13.3 Jurisdiction

You agree to submit to the personal jurisdiction of the courts located in Franklin County, Ohio for any actions not subject to arbitration.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Pet Trial Finder LLC regarding the Service.

14.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

14.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

14.4 Assignment

You may not assign or transfer these Terms without our written consent. We may assign these Terms without restriction.

14.5 Third-Party Beneficiaries

These Terms do not create any third-party beneficiary rights except as expressly stated.

14.6 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, or internet service failures.
